Warez

I have heard tons of things on this topic of Warez. To my understanding you can host and link to warez material on an offshore host? Or is it illegal everywhere? I have heard so many things about it, what do you guys think?

You can link to 3-part warez on US hosting, but it is illegal to host warez on US soil and servers.

Some people say that hosting illegal files in the Netherlands, Sweden, Germany etc is allowed. This is wrong, there is not one country that "allows" warez hosting, all the countrys are within the DMCA policy.

But, some countrys like Netherlands and Sweden don't is not so strict on DMCA notices or what you host. So they basicly let your warez files slip by. But, as they originaly don't allow it, then you can't be assured that they will keep your server / hosting account up and running no matter what.

Either way you put it, it's a bad idea to get into that stuff. I'd rather stick to legit businesses than have to worry about being caught.

To put in my "two cents", pirated files of any sort, and supporting them with your web site is open to many illegal suits and other awful things you could find yourself into someday. There will be companies attacking you if you host or link "warez" files the more popular your web site is.
Either build, buy/save, or write something similiar or better than the product(s) you can't afford.

I will say this, imagine yourself on the computer creating software, a template, an eBook, or anything that can be saved as a file, and you would like some money from your hard word. I understand open-source, but if you want solid payment than you want to put a price tag on it. Now, when you publish it.

Say your first client buys your work, and then put the file or file on a web site and allows the public to access it. Now everyone can obtain the file for free, and you're loosing money.
If you put this concept in company/business-wise, you're stealing from more than one person.

Kevin, your going way off-topic here.. He is asking were you might host warez and were it is illegal, or if it is illegal everywhere.

Yes, but the post was just to point out and to put the idea into his/her head so he can better decide not or do whatever what he could do to support "warez".

I was just wondering, I don't intend to host or start up a warez site. I am actually against pirated software everything I have has been bought . I was just curious if it was actually allowed and if not what legal action can be taken?

Its illegal to host warez, however its legal to link to it. Like heres a common example,

bob wants to see that new movie thats really hot but doesn't wanna cough up the dough to rent it or buy it on DVD/blu-ray

bob goes to x.com and they have a link there to the hot movie which is hosted on videositex.com, x.com to my understanding won't get introuble for linking to it, you won't get into trouble for viewing it (to my understanding), but videositex.com will get in trouble for hosting it.

1st and 2nd part linking is illegal in USA, 3part linking is not illegal.

My Philosophy on Warez

If you use warez to get something, it is fine as long as you buy it in the future. I am not say at all using warez EVER is legal, but i think if you currently do not have the funds for a program, like CS4, and use warez you should buy it for full price in the future. The SAME program. Not an updated version of it. And i have talked to a few software distributors about some software i have on my computer. I had found serials on youtube, all of them say that if i get them somewhere like that without a keygen, depending on if the software is shareware (which all of mine are) it is fine. However use of keygens and such are illegal. Also, be careful...

yes...it does record everything you do in a super compressed DOS based format. It is only deleted on a format, and it can be altered if re-written.

agreed, its not worth hosting or using it...is 1k plus risk worth the cost savings of say buying Office?

From my understanding, it's "legal" if you use offshore hosting in the sense that in the country where the site is being hosted at, the copyright laws don't prohibit you from linking to such content. But I'm not sure if the companies can still sue you and once your site becomes big, it might be risky.

Even then it isn't "legal", it's just that the countries that restrict and regulate warez can't do anything about it when it's offshore.

Actually, some countries dont have laws against piracy. In those places piracy is "legal" in the sense that they dont have laws against it (like the DMCA here). You still have to respect copyright laws and such, and thats the clincher in that area.

So, technically, no matter what you do, its all illegal when it comes down to copyrights.

With offshore hosting warez cannot be hosted on the server, only linked to. I try to stay away from warez as i see a lot of forum owners getting into big trouble concerning warez.
